1. Who operates Portfolio Foundations
Portfolio Foundations is operated by Foundation First Buyers Agency Pty Ltd. In these terms, “Portfolio Foundations”, “we”, “us” and “our” refer to Foundation First Buyers Agency Pty Ltd and the Portfolio Foundations application it operates.

2. Private beta / early access
Portfolio Foundations is provided as a private beta and early-access product. This means it is still in development and:
- it may contain bugs, errors, incomplete features and inaccurate inputs or outputs
- features may be unavailable, change, or be added or removed at any time
- it has local/device data limitations (see section 7)
- your access may be changed, suspended or ended at any time, with or without notice
You should not rely on the beta being available, complete or error-free, and you should keep your own records of anything important.
3. What Portfolio Foundations does
Portfolio Foundations is property portfolio modelling and client reporting software. It provides:
- property portfolio modelling
- scenario comparison
- a Strategy Builder for modelling strategy moves
- Strategy Snapshot reports
- client workspace support for buyer's agents
All outputs are modelled planning estimates based on the assumptions entered. They are not a prediction, guarantee or recommendation.
4. No advice or recommendation
Portfolio Foundations does not provide financial advice, tax advice, legal advice, credit advice, lending advice, lending approval, investment recommendations, or a recommendation to buy, sell, hold, renovate, refinance or acquire property.
Portfolio Foundations provides factual modelling and planning information only. It is not a substitute for advice from a qualified professional. See our Disclaimer for more detail.
5. Your responsibility for information and decisions
- You are responsible for the accuracy and completeness of the information and assumptions you enter.
- You must check the assumptions used and confirm that they are appropriate for your situation.
- You must engage qualified professionals (such as a broker, accountant, solicitor, financial adviser or lender) where needed.
- You must not rely on Portfolio Foundations outputs as the sole basis for any decision.
6. Buyer's agents and client data
- If you enter information about a client, you confirm you have that client's permission or authority to do so.
- You must not enter information you are not authorised to collect, hold or use.
- You are responsible for how you prepare and share Strategy Snapshots with clients, and for presenting outputs as modelled planning estimates.
- You must not remove, hide or alter disclaimers on exported or printed reports.
7. Client workspaces during early access
- During early access, client workspaces you create are stored on the device and browser you use.
- Client workspace data may not sync across devices or browsers.
- Clearing your browser storage, using a different device or browser, or private browsing may remove or hide client workspace data.
- You should keep your own independent records of client reports and information.
8. Acceptable use
You must use Portfolio Foundations lawfully and responsibly. Full guidelines are set out in our Acceptable Use policy, which forms part of these terms. Among other things, you must not misuse the service, present outputs as guaranteed or approved, remove disclaimers, or interfere with the service.
9. Intellectual property
- The Portfolio Foundations application, design, report formats, software and branding are owned by or licensed to us.
- You own, or are responsible for, the data and information you enter.
- During the beta, you are granted a limited, non-exclusive, non-transferable right to access and use Portfolio Foundations for its intended purpose.
- You must not copy, resell, reverse engineer or create derivative products from Portfolio Foundations except as permitted by law.
10. Availability and changes
Portfolio Foundations may be unavailable, interrupted or changed at any time. Features may be added, modified or removed. We do not guarantee uninterrupted or error-free access, and we may perform maintenance or updates without notice.
11. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law or other laws that cannot lawfully be excluded, restricted or modified.
To the maximum extent permitted by law, Portfolio Foundations is provided on an “as is” and “as available” basis, and we are not liable for any loss or damage arising from your use of, or reliance on, Portfolio Foundations or its outputs, including decisions made based on modelled estimates. Where our liability cannot be excluded but can be limited, our liability is limited to the maximum extent permitted by law.
12. Suspension and termination
We may suspend or end your access to Portfolio Foundations at any time, including for misuse, breach of these terms, a security risk, or on closure or change of the beta. You may stop using Portfolio Foundations at any time. Some provisions (including intellectual property, disclaimers and liability) survive termination.
13. Governing law
These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth of Australia.
14. Changes to these terms
We may update these terms from time to time. If we make material changes, we may ask you to accept the updated terms before continuing to use Portfolio Foundations. Continued use after an update means you accept the updated terms.
